TOURING AGREEMENT

This Touring Agreement (“Agreement”) is made by and between (“Buyer”) and [Brokerage Name] (“Broker”) for real property located at the following location(s) or address(es)
1. Purpose of Agreement.
(a) The sole purpose of this Agreement is for Broker to: (i) consult with Buyer regarding specific properties; and (ii) assist Buyer in locating and touring properties. These activities constitute the “Touring Services.”
(b) In connection with providing the Touring Services, Broker shall comply with all requirements of the Kansas Brokerage Relationships in Real Estate Transactions Act, K.S.A. 58-30,101 et seq., all of the duties and obligations set forth in K.S.A. 58-30,113, and comply with any applicable federal, state and local laws, rules, regulations and ordinances.
(c) Buyer and Broker agree that they are entering into a non-exclusive relationship.
2. Buyer's Acknowledgement.
Buyer represents that Buyer has not signed an exclusive buyer brokerage agreement for the Location currently in force with another Broker.
3. Duration of Agreement.
This Agreement is entered into this , 20 . This Agreement shall expire in days at 11:59 p.m. on , 20 .
4. Fee for the Touring Services.
(a) Buyer agrees to compensate Broker for the Touring Services as follows: .
(b) Broker shall not receive compensation for the Touring Services from any source that exceeds the amount or rate agreed to in the agreement with Buyer. For clarity, this shall not be construed to mean the parties can't enter into a subsequent agreement for compensation for additional services as set forth in 4(c) of this agreement.
(c) Under this Agreement, Broker will be acting as a transaction broker and shall not be an agent or advocate of Buyer. If Broker is going to provide Buyer with brokerage services beyond the Touring Services, Buyer and Broker will enter into a separate agreement for such additional brokerage services. The fee or commission the parties agree to for those services are not set by law, are fully negotiable, and shall be documented in that agreement.
5. Equal Opportunity.
Properties shall be shown and be made available to Buyer without regard to race, color, religion, sex (including sexual orientation and gender identity), disability, familial status, national origin, and as may be required by other local, state or federal anti-discrimination laws or regulations.

Along with the touring agreement, Kansas law requires every real estate licensee to provide prospective buyers and sellers with the Kansas Real Estate Commission's Real Estate Brokerage Relationships brochure at the first practical opportunity (the Brokerage Relationships in Real Estate Transactions Act, K.S.A. 58-30,101 et seq.). It's a one-page explanation of the three ways a licensee can work with you, seller's agent, buyer's agent, or transaction broker, and the duties each owes you.

Before You Write an Offer
Needed Before Making an Offer
Almost every seller in the Lawrence area will ask for proof that you can actually close before they take their home off the market for you. Have one of these two documents in hand before you find the house you want, because the strongest homes often go under contract in the first few days and there is rarely time to go get it later.
If you are financing
A written loan approval from an area bank or mortgage broker with an office close enough that you could go meet them in person if you needed to.
Try to avoid online lenders with no nearby office. When something comes up late in a contract, an appraisal question, a document that has to be re-signed, an underwriting condition three days before closing, being able to walk into your lender's office and sit down with a person is worth a great deal. Listing agents know this too, and they weigh a local approval more heavily when a seller is choosing between offers.
If you are paying cash
The seller will want a simple letter from your banker or stock broker, signed by them, confirming you have the funds. It does not need to disclose your balances or your account numbers. A single sentence is enough:
“This buyer has the ability to pay cash for a home or real estate up to $______ in cash at closing.”
Fill in an amount at or above your intended offer price. Signed and on the bank's or brokerage's letterhead is best.

Does the touring agreement cost anything?
Signing a touring agreement to see homes with Bryan does not obligate you to pay a fee for the tour. All broker compensation in Kansas is negotiable and must be stated in a written agreement; the touring agreement's terms are right on its face, and Bryan reviews them with you before you sign.
